This Privacy Policy outlines how ZCA and https://www.zeitcontemporaryart.com/ (the “Website”) (collectively, “we”, “us,” or “our”) collects, uses, protects, and discloses information about you when you use our online or in-person services, including, for example, when you use our Website and online services, when you purchase something from us, consign artwork or other property to us, subscribe to our mailing lists and newsletters, register for and/or attend our events including exhibitions and art fairs, or otherwise interact with us.

    If you have provided us with your information, then this indicates that you have had sufficient opportunity to access, and have read and accepted, this Privacy Policy. If you do not wish to provide personal information to us, then you do not have to do so, however, it may affect your use of our Website or any services offered on it.

    • Contact details including E-mail Address, Address, and Telephone Number;
    • Date of Birth;

    • Your Preferences in receiving marketing and communications from us;
    • (If consummating an acquisition with us) Transaction Information and Information we need to comply with our Know Your Customer (“KYC”) obligations and other legal or auditing obligations;
    • Previous purchases or artworks in your collection;
    • List of artists whose work you have collected;
    • List of artists of interest to you;
    • Museum or similar board/trustee affiliations;
    • Account balances;
    • Credit-card information;
    • Transaction history; and
    • Any other information requested on this Website or otherwise requested by us or provided by you.

     

    Non-identifiable information: This means data that has never been labeled with individual identifiers or from which identifiers have been permanently removed, and by means of which no specific individual can be identified. When you visit our website, we automatically record non-identifiable information that your browser sends. This data may include:

     

    • Your Computer’s IP address and Geolocation Data;
    • Browser type;
    • Operating system;
    • Access times;
    • Webpage you were visiting before you came to our Website;

    Types of Data We Do Not Collect: We do not collect any Special Categories of Personal Data about you, such as details about your race or ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, information about your health, or genetic and biometric information.

     

    Our Website is not intended for children and/or minors under the age of 16, and we do not knowingly collect data relating to children and/or minors.

    Kindly note that if you fail to provide personal data when requested in circumstances in which we need to collect personal data by law, or under the terms of a contract we have with you, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). We will notify you if this is the case.

     

    B) From third parties such as our related entities, businesses, commercial partners, joint-ventures, or acquired companies or assets thereof.

     

    You can ask us or third parties to stop sending you marketing messages at any time by following the opt-out links on any marketing message sent to you or by contacting us. If you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a transaction, such as the acquisition of an artwork.

    • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

    8. DO NOT TRACK SIGNALS

     

    We do not currently respond to 'Do Not Track' signals, as the internet is still working on ‘Do Not Track’ universal standards, implementations, and solutions.

    12. RESIDENTS OF THE EUROPEAN ECONOMIC AREA (EEA) NATIONS HAVE ADDITIONAL RIGHTS:

     

    Where we have acquired your information through your interaction with Zeit Contemporary Art as residents of the European Economic Area (EEA), you have additional rights, by way of the UK Data Protection Act 2018 and the EU’s General Data Protection Regulation.

     

    A) Levels of Personal Information

     

    The levels of personal information we have imported and processed include your name (first and last name), e-mail address, date(s) that you opted-in to receive communications or marketing material and later confirmed your opt-in, your region and time zone, and the date (if applicable) that you last changed your marketing preferences.

     

    B) Bases on Which We Rely to Process Your Information

     

    The type of lawful basis on which we rely to process your information is known as the “legitimate interest” basis. This means the interest of our business in conducting and managing our business to enable us to provide our services and give you the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities in which our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). We may also process your data when it is reasonably necessary to achieve our legitimate business interests.

    • Request a copy of your personal information in a structured, digital format (data portability). You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
    • Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.     Again, you have a right to request a copy of your data (to review and update it), as well as the right to have your data deleted. You also have the right to withdraw your consent to mailings/notifications at any time, by clicking the link in our email footer, or by contacting us at contact@zeitcontemporaryart.com.

     

    We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

     

    We try to respond to all legitimate requests within one month. Occasionally, it could take us longer than a month if your request is particularly complex or you have made several requests. In this case, we will notify you and keep you updated.

     

    You will not have to pay a fee to access your personal data (or to exercise any of the other rights). We may charge a reasonable fee, however, if your request is clearly unfounded, repetitive, or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

     

    D) Data Retention

     

    We will only retain your personal data for as long as reasonably necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

     

    To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

     

    In some circumstances, you can ask us to delete your data (see your legal rights at Section 12.C above, for further information).

     

    In some circumstances, we will anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

     

    In some circumstances, the personal information we collect may be transferred to, and stored at, a destination outside the European Economic Area (EEA). It may also be processed by staff operating outside the EEA who work for us or for one of our agents. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and the GDPR.

     

    E) Data Security

     

    We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.

     

    We have put in place procedures to deal with any suspected personal data breach and will promptly notify you and any applicable regulator of a breach where we are legally required to do so.
